E. Timor Prosecutors File More Human Rights Charges
Fri February 28, 2003 02:05 AM ET
Dili (Reuters)
East Timor prosecutors charged more than 50 people, including a former police
chief and a militia boss, with crimes against humanity Friday over violence
surrounding a 1999 vote for independence from Indonesia.
Among those indicted, according to a statement from the serious crimes unit in
East Timor, were the former Indonesian chief of police for East Timor, Timbul
Silaen, and a former leader of pro-Jakarta militias, Eurico Guterres.
They were charged "with counts of crimes against humanity including murder,
enforced disappearance, inhumane acts and deportation." Most of the others
charged in the indictments were members of the militias.
Earlier this week charges were filed against eight other people, including a
former Indonesian armed forces chief, General Wiranto, and a former governor of
East Timor.
Indonesia has so far ruled out sending any of its former officials to East
Timor to stand trial.
Guterres, former chief of the feared Aitarak militia, was sentenced in November
by an Indonesian human rights court to 10 years in jail on similar charges. He
is appealing against the conviction.
Silaen was also tried in Indonesia but acquitted.
The Indonesian human rights court has delivered verdicts in the cases of 15 out
of 18 suspects charged over alleged human rights violations in East Timor, and
has handed down convictions in four of the cases.
In the latest development in the Indonesian hearings, a court Friday postponed
for two weeks a verdict on Brigadier-General Noer Moeis, who commanded
Indonesian troops in East Timor at the time of the August 30, 1999, ballot in
which its citizens voted overwhelmingly to end Jakarta's 24-year rule.
The United Nations estimates more than 1,000 people were killed in violence
surrounding the vote. Most of the victims were supporters of East Timor's
independence from Indonesia, which invaded the former Portuguese colony in 1975
and annexed it the following year.

East Timor War Crimes Panel Indicts 49
By Guido Guilart
Associated Press Writer
February 28, 2003, 4:08 AM EST
Dili, East Timor -- A U.N.-led panel indicted a notorious militia leader, East
Timor's former police chief and 47 others Friday on charges of crimes against
humanity during violence that swept the territory in 1999.
Eurico Guterres, once the leader of the feared Aitarak militia, and Brig. Gen.
Timbul Silaen, the former police chief, were charged along with the others for
crimes including murder, inhumane acts and forced disappearance.
On Tuesday, prosecutors also indicted Indonesia's ex-military chief Wiranto for
the violence that killed 1,000 and forced 250,000 from their homes before and
after the vote.
The indictments are the latest efforts to bring to justice the perpetrators of
the violence in East Timor, which gained its independence in May and is the
world's youngest nation.
On Friday, East Timorese President Xanana Gusmao criticized the indictment of
Wiranto and seven other senior Indonesian officers. Gusmao, who cannot
intervene, has said impoverished East Timor should be more concerned with
forging strong economic ties and good relations with its neighbor than pursuing
the suspects.
"I consider the execution of that kind of justice in East Timor not to be in
the national interest," Gusmao said.
Guterres and Silaen are both believed to be in Indonesia, and the United
Nations said it will forward the indictments to the Indonesian Attorney
General's office. Indonesia has already said it has no plans to turn over
anyone to East Timorese courts.
Guterres has already been sentenced to 10 years in prison by an Indonesian
court for his role in the violence, while Silaen was found not guilty by the
same court. Guterres remains free while he appeals his case.
Both men were among eight charged over a Sept. 5, 1999 attack on the Roman
Catholic diocese office in the East Timorese capital of Dili where hundreds had
sought refuge. Fifteen people were killed in the attack. A day later, the same
mob attacked the home of Roman Catholic Bishop Carlos Belo.
The rest of those indicted -- most of them Timorese militia members -- were
accused of taking part in a series of attacks during 1999, including a church
massacre in the village of Suai on Sept. 6, 1999 in which 31 Timorese refugees
were killed.
The United Nations governed East Timor for 2 1/2 years until the territory
achieved independence. It still provides the nation with government advisers,
several hundred policemen and about 2,500 peacekeeping troops.
